Nirvana Baby Loses Child Pornography Lawsuit Against ‘Nevermind’ Cover Album 

I guess, “nevermind” then?

Remember the iconic poster of Nirvana’s Nevermind studio album? The one which shows a baby, sans clothes (or diapers) chasing a dollar bill? As it turns out, the now-grown man recently moved to court to sue the band for sexual exploitation!  

 

Spencer Elden, who is now 31, accused the grunge band of engaging in child pornography for using his picture on the album cover. However, the lawsuit was soon dismissed citing that Elden had “waited too long to file his lawsuit.”

The case was filed in California against the estate of Kurt Cobain and his former band members David Grohl and Krist Novoselic. After the dismissal, the attorney for the defendants released a statement saying they were “pleased this meritless case has been brought to a swift conclusion.”  

 

Elden, who makes a living as an artist claim that he has gone to therapy for years to work through the trauma the album cover bought him, saying that his privacy had been invaded. He had been seeking compensation of $150,000 from each of the 15 people and companies named in the lawsuit.

Being four months old at the time, Elden’s photo was picked from dozen other pictures of babies photographed by Kirk Weddle, who allegedly paid Elden’s parents $200 for the use of the picture. However, what’s interesting is Elden’s opinion on the photo has changed throughout the years, with him recreating the moment for the album’s 10th, 17th, 20th, and 25th anniversaries (while being clothed).  

 

Elden has though, voiced his opposition before during an interview with GQ Australia saying that he wasn’t comfortable with people seeing him naked, adding “I didn’t really have a choice.”
